Don’t panic—an RFE is not a denial. Receiving a Request for Evidence (RFE) from U.S. Citizenship and Immigration Services (USCIS) can be stressful, but it does not mean your application has been denied. An RFE simply means that USCIS needs additional information or documentation before making a decision on your case. In many situations, responding correctly and on time can keep your application moving forward.
What is an RFE? A Request for Evidence is an official notice from USCIS asking for more information to complete the review of your application. USCIS may request:
Common Reasons USCIS Issues an RFE Some of the most common reasons include: 1. Missing documentation Supporting evidence such as birth certificates, marriage certificates, tax returns, or employment records may not have been included. 2. Insufficient evidence USCIS may determine that the documents submitted do not fully establish eligibility for the immigration benefit requested. 3. Missing signatures Applications with missing or incorrect signatures may require additional action before they can continue processing. 4. Inconsistent information If information differs between forms or supporting documents, USCIS may request clarification. 5. Medical examination issues For certain applications, USCIS may require an updated or properly completed medical examination. What Should You Do After Receiving an RFE? Read the notice carefully. Every RFE explains exactly what USCIS is requesting. Avoid guessing or submitting documents that were not requested. Respect the deadline. USCIS establishes a response deadline. Missing that deadline may result in the denial of your application. Submit a complete response. Whenever possible, respond with all requested evidence at the same time. Sending incomplete information could lead to additional delays. Keep copies of everything. Maintain copies of your RFE, supporting documents, and proof of mailing for your records. Can an RFE Be Approved? Yes. Many immigration applications are approved after USCIS receives a complete and timely response. The key is providing accurate documentation that addresses every issue raised in the notice. How an Immigration Attorney Can Help? An experienced immigration attorney can:
