Adjustment of Status vs. Consular Processing: Which Option Is Right for You?

6/12/2026

If you are seeking lawful permanent residence in the United States, you may have heard the terms "Adjustment of Status" and "Consular Processing." While both pathways can lead to obtaining a Green Card, the process and requirements can be very different.
Understanding the difference is important when determining the best option for your situation.

What Is Adjustment of Status?
Adjustment of Status is the process of applying for a Green Card from within the United States.
This option may be available to certain individuals who are already physically present in the U.S. and meet the eligibility requirements.
One of the main advantages of Adjustment of Status is that applicants generally remain in the United States while their case is pending.

What Is Consular Processing?
Consular Processing is the process of applying for an immigrant visa through a U.S. Embassy or Consulate outside of the United States.
After completing the required steps and attending an interview abroad, eligible applicants may enter the United States as lawful permanent residents.

Key Differences
Adjustment of Status
✔ Application filed from within the United States
✔ Applicant generally remains in the U.S. during the process
✔ May be eligible for work and travel authorization while the case is pending

Consular Processing
✔ Application completed through a U.S. Embassy or Consulate
✔ Applicant attends an interview outside the United States
✔ Processing times and requirements may vary depending on the country and individual circumstances

Which Option Is Better?
There is no one-size-fits-all answer.
The best option depends on several factors, including your immigration history, current location, family relationship, eligibility, and long-term goals.
Because every case is unique, it is important to have your situation evaluated before deciding which path may be appropriate for you.

Ajuste de Estatus vs. Proceso Consular: ¿Cuál Es la Mejor Opción Para Usted?

6/12/2026

Federal Court Blocks USCIS Policies That Delayed Certain Immigration Cases

6/10/2026

A federal court recently issued an important decision that may affect some immigration cases that were delayed or placed on hold by USCIS.

In the case Dorcas v. USCIS, a judge ruled that certain USCIS policies were not lawful and can no longer be used.

What Happened?
USCIS had been delaying or pausing certain immigration cases involving people from several countries.
The court ruled that those policies cannot continue to be used.

What Does This Mean?
For some individuals, this may mean that immigration cases that were previously delayed could move forward.

However, it is important to understand that:
  • This decision does not automatically approve any case.
  • USCIS will still review each application individually.
  • Immigration requirements and eligibility rules still apply.

Could This Affect You?
If your immigration case was delayed, placed on hold, or has been pending for an unusually long time, this decision may be important to your situation.

Every case is different, and the impact of this ruling will depend on your specific circumstances.
